GDPR Compliance
Our Commitment to Data Protection
Voicemetrics LLC ("we," "us") is fully committed to upholding the principles of the General Data Protection Regulation (GDPR). This page serves as a dedicated resource for our users in the European Union (EU), European Economic Area (EEA), and the United Kingdom (UK), explaining your rights and our practices under the GDPR.
This statement should be read in conjunction with our main [Privacy Policy], which provides comprehensive details on the data we collect and how we process it.
1. Our Role: Data Controller vs. Data Processor
Under the GDPR, our role can change depending on the situation. It is important to understand this distinction:
- We are the Data Controller of your personal information when you visit our website (https://voicemetrics.ai), sign up for an account, or communicate directly with us. In this role, we determine the purposes and means of processing your data.
- We are the Data Processor when our clients use our voice AI software ("Services") to process personal data belonging to their own customers. In this capacity, our client is the Data Controller, and we process the data on their behalf and according to their instructions. Our obligations as a Data Processor are governed by our Data Processing Addendum (DPA) with our clients.
2. Our GDPR Principles
We process all personal data based on the core principles of the GDPR:
- Lawfulness, Fairness, and Transparency: We process data lawfully and provide clear information about our practices.
- Purpose Limitation: We only collect data for specified, explicit, and legitimate purposes.
- Data Minimization: We only collect and process data that is adequate, relevant, and necessary.
- Accuracy: We take reasonable steps to ensure personal data is accurate and up-to-date.
- Storage Limitation: We do not keep personal data for longer than is necessary.
- Integrity and Confidentiality: We use appropriate technical and organizational measures to ensure the security of the data.
3. Your Data Subject Rights Under GDPR
The GDPR provides you with eight fundamental rights. You can exercise these rights regarding the data for which we are the Data Controller.
- The Right to Access: You have the right to request a copy of the personal information we hold about you.
- The Right to Rectification: You can ask us to correct any information you believe is inaccurate or incomplete.
- The Right to Erasure (The "Right to be Forgotten"): You can ask us to delete your personal information in certain situations.
- The Right to Restrict Processing: You have the right to request that we limit the processing of your personal data under certain conditions.
- The Right to Data Portability: You can request that we transfer the data we have collected on you to another organization, or directly to you, in a structured, machine-readable format.
- The Right to Object: You have the right to object to our processing of your personal data where we are relying on "legitimate interests" as our legal basis.
- The Right to Withdraw Consent: If we are processing your data based on your consent, you can withdraw that consent at any time.
- Rights Related to Automated Decision-Making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal or similarly significant effects on you.
How to Exercise Your Rights To exercise any of these rights, please submit a verifiable request to our data protection team at support@voicemetrics.ai. We will respond to your request within 30 days, in accordance with GDPR requirements.
4. Legal Basis for Processing and International Transfers
- Legal Basis: As detailed in our [Privacy Policy], we process your data based on legal grounds such as your consent, the necessity to perform a contract with you, compliance with a legal obligation, or our legitimate interests (e.g., improving our Services and preventing fraud).
- International Data Transfers: As Voicemetrics LLC is based in the United States, your data is transferred and processed there. We ensure these transfers are lawful and secure by using approved data transfer mechanisms, such as Standard Contractual Clauses (SCCs), as recognized by the European Commission.
5. Data Protection Contact
For any questions, concerns, or requests related to GDPR and your data privacy, please contact us. While we may not be formally required to have a Data Protection Officer (DPO), we have designated a point of contact for all data protection inquiries.
